Terms of Service

Welcome to Bahd.

These Terms of Service ("Terms") govern access to and use of the Bahd website, mobile applications, cashier applications, and related services (collectively, the "Platform").

The Platform is owned and operated by IOUTDEV PLC ("Bahd", "we", "our", or "us").

By creating an account, accessing, or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.

Bahd is a technology platform that facilitates the discovery, comparison, booking, management, and sale of transportation services.

Transportation services available through the Platform are provided by independent transportation operators ("Providers").

When a user purchases a ticket through Bahd, the transportation contract is entered into between the passenger and the relevant Provider. Bahd acts solely as a software and booking intermediary.

To use the Platform, you must have the legal capacity to enter into binding agreements under applicable law, or use the Platform with the involvement, authorization, or supervision of a parent, guardian, or other legally responsible person where required by law.

By using the Platform, you represent that the information you provide is accurate and complete.

Users may be required to create an account to access certain features. You are responsible for:

• Maintaining the confidentiality of your account
• Protecting login credentials
• All activity occurring under your account
• Keeping your information current and accurate

You must immediately notify Bahd of any suspected unauthorized access to your account.

The Platform supports different categories of users.

A ticket purchase made through Bahd constitutes a booking request for transportation services provided by the selected Provider. Ticket availability displayed on the Platform may change without notice.

A booking is considered confirmed only after:

• Payment is successfully processed
• Confirmation is issued through the Platform

Providers are responsible for ensuring the accuracy of schedules, fares, route information, seat availability, and operational details.

Prices displayed through the Platform are determined by Providers unless otherwise indicated. Payments may be processed through approved payment service providers, including:

• Chapa
• Other payment providers made available by Bahd

Bahd does not store full payment credentials. Users are responsible for ensuring sufficient funds and accurate payment information.

A transaction may be declined, delayed, or cancelled by payment providers for reasons beyond Bahd's control.

Transportation services offered through Bahd are subject to the policies of the relevant Provider. Refund eligibility, cancellation rights, rescheduling options, boarding requirements, and related conditions are primarily determined by the Provider operating the service.

Bahd may provide technical tools to facilitate cancellation or refund requests but does not guarantee approval of any refund request. Refund decisions remain subject to:

• Provider policies
• Applicable law
• Payment processor requirements

If a passenger misses a departure, eligibility for any refund, credit, rebooking, or compensation shall be determined by the Provider's policies.

Providers are solely responsible for:

• Transportation operations
• Vehicle condition
• Driver conduct
• Safety compliance
• Licensing requirements
• Boarding procedures
• Baggage policies
• Service delivery

Bahd does not supervise transportation operations and cannot guarantee:

• Departure or arrival times
• Vehicle conditions
• Service quality
• Route availability

Travel schedules may be affected by weather, traffic, road conditions, government actions, technical failures, security concerns, or other circumstances beyond the control of Bahd.

Bahd may provide a cashier application or related tools to authorized Providers. Providers are responsible for:

• Proper use of cashier systems
• Accuracy of ticket sales
• Accuracy of passenger information entered
• Compliance with applicable laws
• Management of cash and financial records
• Activities performed by their employees and agents

Users agree not to:

• Provide false information
• Use another person's account
• Interfere with Platform operations
• Attempt unauthorized access
• Circumvent security measures
• Engage in fraudulent activity
• Distribute malware or harmful software
• Use the Platform for unlawful purposes

Providers represent and warrant that they:

• Hold all licenses required to operate transportation services
• Have authority to offer services through Bahd
• Provide accurate route and schedule information
• Maintain legally required insurance and permits where applicable
• Comply with Ethiopian laws and regulations

Providers remain solely responsible for their transportation services and interactions with passengers.

Bahd aims to provide reliable access to the Platform but does not guarantee uninterrupted availability. The Platform may occasionally experience:

• Maintenance interruptions
• Network failures
• Third-party service disruptions
• Technical issues

Bahd may suspend or modify portions of the Platform without prior notice.

All rights, title, and interest in the Platform, including software, branding, logos, content, and technology, belong to IOUTDEV PLC or its licensors. No ownership rights are transferred to users through use of the Platform.

Users may not copy, modify, reverse engineer, distribute, or exploit Platform content except as permitted by law.

To the maximum extent permitted by applicable law, Bahd shall not be liable for:

• Transportation delays or missed departures
• Service interruptions by Providers
• Vehicle breakdowns or route changes
• Accidents or passenger injuries caused by Providers
• Loss or damage of baggage
• Actions or omissions of Providers
• Indirect, incidental, consequential, or special damages

Users and Providers agree to indemnify and hold harmless IOUTDEV PLC, its directors, officers, employees, and affiliates from claims, losses, damages, liabilities, and expenses arising from:

• Violation of these Terms
• Misuse of the Platform
• Violation of law
• Infringement of third-party rights

Bahd may suspend or terminate access to the Platform if a user or Provider:

• Violates these Terms
• Engages in fraud
• Creates security risks
• Uses the Platform unlawfully

Termination does not affect obligations arising before termination.

These Terms shall be governed by and interpreted in accordance with the laws of the Federal Democratic Republic of Ethiopia.

Any dispute arising from or relating to these Terms shall be subject to the jurisdiction of the competent courts of Ethiopia unless otherwise required by law.

Bahd may update these Terms from time to time.

Updated versions become effective when published on the Platform. Continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.
